1. Acceptance of Terms

By accessing and using Bookfolio ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Bookfolio is a mobile application that enables users to swap books with other readers. The Service includes book listing, search, swap requests, shipping coordination, and subscription-based premium features.

3. User Accounts

• You must be at least 13 years old to use this Service
• You are responsible for maintaining the confidentiality of your account
• You must provide accurate and complete information
• You are responsible for all activities under your account
• You must verify your email address to use the Service

4. Book Swapping Rules

4.1 Book Listings

• You may only list books you legally own
• Books must be in the condition you describe
• You must provide accurate book information
• Prohibited items include damaged, illegal, or inappropriate content

4.2 Swap Process

• Swaps are binding agreements between users
• You must ship books within 7 days of acceptance
• Provide tracking information when shipping
• Report any issues within 48 hours of delivery
• Both parties must confirm swap completion

4.3 Shipping and Liability

• Users are responsible for shipping costs
• Shipping label fees range from €0.15–€0.35 per label, depending on your plan
• Use appropriate packaging to protect books
• Bookfolio is not liable for shipping delays or damage
• Disputes should be resolved between users first

5. Subscription Plans

5.1 Bookmarker (Free)

• Unlimited book listings and swaps
• €0.99 platform fee per swap
• Ad-supported experience
• Basic customer support

5.2 Bookworm (€3.99/month)

• First 5 swaps free every month
• €0.50 per swap after the first 5
• Ad-free experience
• Priority customer support

5.3 Bibliophile (€9.99/month)

• Unlimited swaps with no platform fees
• Ad-free experience
• Premium customer support
• Early access to new features

Platform fees are separate from shipping label fees. Subscription and swap payments are processed securely via Stripe.

6. Points System

• Users earn 1 point for each completed swap
• Points may be used for future discounts and rewards
• Points are non-transferable and have no cash value
• Points expire after 12 months of inactivity

7. Prohibited Activities

You agree not to:

• List illegal, stolen, or counterfeit books
• Provide false or misleading information
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Attempt to circumvent security measures
• Use the Service for commercial purposes without permission
• Share inappropriate or offensive content

8. Payment Terms

• Subscription fees are billed monthly in advance
• All fees are non-refundable unless required by law
• We may change subscription prices with 30 days notice
• Failed payments may result in service suspension

9. Intellectual Property

• Bookfolio owns all rights to the Service and its content
• Users retain ownership of their book listings
• You grant us a license to use your content to provide the Service
• Respect others' intellectual property rights

10. Disclaimers

• The Service is provided "as is" without warranties
• We do not guarantee the accuracy of book information
• We are not responsible for user-to-user transactions
• We do not endorse any specific books or users

11. Limitation of Liability

To the maximum extent permitted by law, Bookfolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

12. Termination

• You may terminate your account at any time
• We may suspend or terminate accounts for violations
• Upon termination, your right to use the Service ceases
• Certain provisions survive termination

13. Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform for consumer disputes: https://ec.europa.eu/consumers/odr.

We are not obliged to participate in alternative dispute resolution proceedings, but are willing to seek an amicable solution in case of complaints. Please contact us first at contact@bookfolio.eu.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes through the app or email. Continued use constitutes acceptance of the modified terms.

15. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. For consumers, mandatory consumer protection provisions of your country of residence remain unaffected.
